According to experts at legal firm Cliffe Dekker Hofmeyr, employees who don’t follow South Africa’s Covid-19 regulations outside of the office, could face disciplinary action at work too.

According to the firm, South African employers are required to adhere to the Occupational Health and Safety Act, which requires them to create a working environment that is safe and holds no risks to the health of employees. Employers must also take steps to eliminate or mitigate the hazard or potential hazard of the Coronavirus.

Becoming sick vs intentionally breaking the rules 

The firm made clear to BusinessTech that it’s important to distinguish between an employee becoming sick in the ordinary course and an employee who deliberately disobeys the preventative measures that were put in place to curb the transmission of Covid-19.
